Welkom bij StreamPilot. Dit zijn de gebruiksvoorwaarden (ook: algemene voorwaarden) die gelden tussen jou als gebruiker en Gamerun, de eenmanszaak van Marc van Gemeren die StreamPilot ontwikkelt en exploiteert. Door een account aan te maken of de dienst te gebruiken ga je akkoord met deze voorwaarden. Lees ze rustig door — we proberen het zo helder mogelijk te houden.

Welcome to StreamPilot. These Terms of Service govern the relationship between you as a user and Gamerun, the sole proprietorship of Marc van Gemeren that develops and operates StreamPilot. By creating an account or using the service you agree to these terms. We have tried to keep them as clear and readable as possible.

1. Partijen en dienst / Parties and Service

Aanbieder: Gamerun, een eenmanszaak naar Nederlands recht, ingeschreven in het Handelsregister van de Kamer van Koophandel, gevestigd in Nederland. Handelsnaam voor deze dienst: StreamPilot.

Dienst: StreamPilot is een online dashboard waarmee streamers op Twitch en YouTube hun stream-overlays, modules (muziekspeler, goals, timers, chat, wiel, newsfeed), automatisering en statistieken kunnen beheren. De dienst omvat een webapp, een bijbehorende Interaction Worker (voor verwerking van Twitch EventSub en chatcommands) en een marketplace voor stream-templates en stijlen.

Provider: Gamerun, a sole proprietorship under Dutch law, registered in the Dutch Chamber of Commerce trade register, based in the Netherlands. Trading name for this service: StreamPilot.

Service: StreamPilot is an online dashboard that allows Twitch and YouTube streamers to manage stream overlays, modules (music player, goals, timers, chat, wheel, newsfeed), automation and statistics. The service includes a web app, an Interaction Worker (for processing Twitch EventSub events and chat commands) and a marketplace for stream templates and styles.

2. Account

2.1 Aanmaken / Creation

Om StreamPilot te gebruiken maak je een account aan met een e-mailadres en wachtwoord, of via een Twitch- of YouTube-koppeling. Je bent zelf verantwoordelijk voor de juistheid van de opgegeven gegevens en de veiligheid van je inloggegevens.

To use StreamPilot you create an account with an email address and password, or via a Twitch or YouTube connection. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.

2.2 Verwijdering door gebruiker / User Deletion

Je kunt je account op elk gewenst moment zelf verwijderen via de accountinstellingen. Na verwijdering worden al jouw persoonsgegevens en gekoppelde content binnen 30 dagen definitief van onze servers verwijderd, tenzij bewaring langer verplicht is op grond van wet- of regelgeving (zoals fiscale bewaarplichten).

You may delete your account at any time via the account settings. After deletion, all your personal data and associated content will be permanently removed from our servers within 30 days, unless a longer retention period is required by law or regulation (such as tax record retention obligations).

2.3 Afsluiting door Gamerun / Closure by Gamerun

Gamerun behoudt zich het recht voor een account te schorsen of definitief te sluiten als:

  • er sprake is van (een vermoeden van) schending van deze voorwaarden;
  • de account wordt gebruikt voor misbruik, spam, fraude of illegale activiteiten;
  • een betaling langdurig uitblijft (bij betaalde abonnementen);
  • wettelijke verplichtingen of een rechterlijk bevel dit vereisen.

Bij schorsing of sluiting om een van de eerste twee redenen ontvang je hiervan zo snel mogelijk bericht per e-mail. Bij ernstig misbruik of fraude kan dit ook zonder voorafgaande waarschuwing.

Gamerun reserves the right to suspend or permanently close an account if:

  • there is (suspected) violation of these terms;
  • the account is used for abuse, spam, fraud or illegal activities;
  • a payment is overdue for an extended period (for paid subscriptions);
  • legal obligations or a court order require it.

In case of suspension or closure for the first two reasons you will be notified by email as soon as possible. In cases of serious abuse or fraud this may happen without prior warning.

3. Toegestaan gebruik / Acceptable Use

StreamPilot is bedoeld als tool voor streamers om hun eigen kanaal te ondersteunen. Het is niet toegestaan om StreamPilot te gebruiken voor:

  • Illegale activiteiten of het omzeilen van auteursrecht, merkrecht of andere intellectuele eigendomsrechten;
  • Het verspreiden van schadelijke, beledigende, discriminerende of anderszins onrechtmatige inhoud;
  • Geautomatiseerd of massaal bevragen van de API buiten de bedoelde dashboardfuncties om;
  • Het verkrijgen van ongeoorloofde toegang tot systemen van StreamPilot of van derden;
  • Het doorverkopen, verhuren of sublicentiëren van de dienst aan anderen, tenzij uitdrukkelijk schriftelijk toegestaan door Gamerun;
  • Het namaken of reverse-engineeren van de software of het platform.

StreamPilot is intended as a tool for streamers to support their own channel. You may not use StreamPilot for:

  • Illegal activities or circumventing copyright, trademark or other intellectual property rights;
  • Distributing harmful, offensive, discriminatory or otherwise unlawful content;
  • Automated or bulk querying of the API outside the intended dashboard features;
  • Gaining unauthorized access to StreamPilot systems or third-party systems;
  • Reselling, renting or sublicensing the service to others, unless expressly permitted in writing by Gamerun;
  • Copying or reverse-engineering the software or platform.

4. Door gebruikers geüploade bestanden / User-Uploaded Content

4.1 Jouw verantwoordelijkheid / Your Responsibility

StreamPilot biedt de mogelijkheid om mediabestanden te uploaden (afbeeldingen, video's, WebM-animaties) voor gebruik in jouw stream-overlays. Door een bestand te uploaden verklaar en garandeer je dat:

  • Je de rechthebbende bent van het bestand, of beschikt over een geldige licentie die gebruik in een live-streamingcontext toestaat;
  • Het uploaden en gebruiken van het bestand geen inbreuk maakt op auteursrechten, portretrechten, merkrechten of andere rechten van derden;
  • Je het bestand niet zult gebruiken op een manier die in strijd is met de voorwaarden van het streamingplatform waarop je uitzendt (Twitch, YouTube, etc.).

StreamPilot allows you to upload media files (images, videos, WebM animations) for use in your stream overlays. By uploading a file you declare and warrant that:

  • You are the rights holder of the file, or you hold a valid licence permitting use in a live-streaming context;
  • Uploading and using the file does not infringe any copyright, portrait rights, trademark rights or other third-party rights;
  • You will not use the file in a way that violates the terms of the streaming platform you broadcast on (Twitch, YouTube, etc.).

4.2 Rol van StreamPilot / StreamPilot's Role

StreamPilot treedt uitsluitend op als technische hostingdienst voor door gebruikers geüploade bestanden. StreamPilot is geen producent, uitgever of verspreider van die inhoud en aanvaardt geen verantwoordelijkheid voor de rechtmatigheid of inhoud ervan.

StreamPilot acts solely as a technical hosting service for user-uploaded files. StreamPilot is not the producer, publisher or distributor of that content and accepts no responsibility for its legality or content.

4.3 Verwijdering van inbreukmakend materiaal / Takedown

Ontvangt StreamPilot een melding van een rechthebbende dat een geüpload bestand inbreuk maakt op diens rechten, dan zal StreamPilot het bestand onverwijld verwijderen of de toegang daartoe onmogelijk maken, de accounthouder informeren, en bij herhaalde inbreuk het account kunnen opschorten of beëindigen. Meldingen kunnen worden ingediend via copyright@streampilot.nl.

If StreamPilot receives a notification from a rights holder that an uploaded file infringes their rights, StreamPilot will promptly remove the file or disable access to it, notify the account holder, and may suspend or terminate the account in case of repeated infringement. Notices can be submitted to copyright@streampilot.nl.

5. Derde platforms / Third-Party Platforms

StreamPilot is een hulpmiddel dat werkt bovenop externe platforms zoals Twitch, YouTube, Spotify, StreamElements, Streamlabs en Stripe. Gamerun heeft geen invloed op het beleid of de beschikbaarheid van deze platforms.

Je blijft zelf verantwoordelijk voor de naleving van de voorwaarden van elk platform dat je via StreamPilot koppelt. Gamerun is niet aansprakelijk voor:

  • Schorsing of beëindiging van jouw account op een extern platform als gevolg van jouw gebruik van StreamPilot;
  • Wijzigingen in de API's of beleidsregels van externe platforms die de werking van StreamPilot (tijdelijk) beïnvloeden;
  • Downtime of storingen bij externe platforms;
  • Dataverlies door wijzigingen in de OAuth-scopes of API-beperkingen van externe platforms.

Koppeling met een extern platform verloopt via OAuth of API-tokens die jij zelf instelt. Door een koppeling tot stand te brengen geef je StreamPilot toestemming om namens jou gebruik te maken van de toegestane scopes van dat platform, zoals beschreven in ons privacybeleid.

StreamPilot is a tool that works on top of external platforms such as Twitch, YouTube, Spotify, StreamElements, Streamlabs and Stripe. Gamerun has no influence over the policies or availability of these platforms.

You remain solely responsible for complying with the terms of each platform you connect via StreamPilot. Gamerun is not liable for:

  • Suspension or termination of your account on an external platform as a result of your use of StreamPilot;
  • Changes to the APIs or policies of external platforms that (temporarily) affect StreamPilot's functionality;
  • Downtime or outages at external platforms;
  • Data loss due to changes in OAuth scopes or API restrictions of external platforms.

Connecting an external platform happens via OAuth or API tokens that you configure. By establishing a connection you authorise StreamPilot to use the permitted scopes of that platform on your behalf, as described in our privacy policy.

6. Betaling en restitutie / Payment and Refunds

6.1 Abonnement / Subscription

Sommige functies van StreamPilot zijn beschikbaar via een betaald abonnement. Prijzen en abonnementsvormen worden op de website vermeld. Betaling geschiedt via de aangeboden betaalmethoden. Een abonnement verlengt automatisch tenzij je het opzegt vóór de einddatum van de lopende periode.

Some features of StreamPilot are available via a paid subscription. Prices and subscription types are listed on the website. Payment is made via the offered payment methods. A subscription renews automatically unless you cancel before the end of the current period.

6.2 Herroepingsrecht / Right of Withdrawal

Bij het afsluiten van een abonnement of het aanschaffen van een marketplace-item geef je uitdrukkelijk toestemming voor directe levering van de digitale dienst of digitale inhoud. Je erkent en aanvaardt hiermee dat het herroepingsrecht (artikel 6:230o BW) niet van toepassing is zodra de levering is gestart, omdat de dienst onmiddellijk beschikbaar is gesteld op jouw uitdrukkelijk verzoek.

Dit wordt je gevraagd te bevestigen op het moment van aankoop ("Ik ga akkoord met directe levering en begrijp dat ik geen herroepingsrecht heb na activering").

When taking out a subscription or purchasing a marketplace item, you expressly consent to immediate delivery of the digital service or digital content. You thereby acknowledge and accept that the right of withdrawal (Article 6:230o Dutch Civil Code) does not apply once delivery has started, because the service is made available immediately at your explicit request.

You will be asked to confirm this at the point of purchase ("I agree to immediate delivery and understand that I have no right of withdrawal after activation").

6.3 Restitutie / Refunds

Gelet op de directe beschikbaarstelling van digitale diensten worden betalingen in beginsel niet terugbetaald. Uitzonderingen worden per geval beoordeeld door Gamerun. Indien je een abonnement opzegt, blijft het tot het einde van de betaalde periode actief; er vindt geen pro-rata terugbetaling van het resterende deel van de periode plaats.

Given the immediate availability of digital services, payments are in principle non-refundable. Exceptions are assessed on a case-by-case basis by Gamerun. If you cancel a subscription, it remains active until the end of the paid period; no pro-rata refund of the remaining portion of the period is made.

6.4 Marketplace-items / Marketplace Items

Aangeschafte marketplace-items (templates, chat-stijlen, overlay-pakketten) worden gekoppeld aan jouw account en zijn uitsluitend voor persoonlijk gebruik op jouw eigen stream(s). Doorverkoop, overdracht aan derden of het buiten StreamPilot om distribueren van aangeschafte items is niet toegestaan. Gamerun behoudt het recht om marketplace-items te verwijderen of bij te werken als dat technisch of inhoudelijk noodzakelijk is; in dat geval zal een passende oplossing worden geboden (bijv. een vervangend item of terugbetaling).

Purchased marketplace items (templates, chat styles, overlay packages) are linked to your account and are for personal use on your own stream(s) only. Resale, transfer to third parties or distribution of purchased items outside StreamPilot is not permitted. Gamerun reserves the right to remove or update marketplace items if technically or editorially necessary; in that case an appropriate remedy will be offered (e.g. a replacement item or refund).

7. Intellectueel eigendom / Intellectual Property

7.1 Eigendom gebruikerscontent / User Content Ownership

Content die jij uploadt of aanmaakt binnen StreamPilot (afbeeldingen, overlay-instellingen, teksten) blijft jouw eigendom. Door deze content in StreamPilot te plaatsen verleen je Gamerun een niet-exclusieve, royaltyvrije licentie om die content te hosten en te serveren ten behoeve van jouw gebruik van de dienst. Deze licentie eindigt wanneer je de content verwijdert of je account beëindigt.

Content you upload or create within StreamPilot (images, overlay settings, texts) remains your property. By placing this content in StreamPilot you grant Gamerun a non-exclusive, royalty-free licence to host and serve that content for the purpose of your use of the service. This licence ends when you remove the content or close your account.

7.2 Marketplace-preview en marketing / Marketplace Preview and Marketing

Indien je items aanbiedt via de marketplace van StreamPilot, geef je Gamerun toestemming om afbeeldingen en previews van die items te tonen aan andere gebruikers ten behoeve van de marketplace. Daarnaast mag Gamerun geanonimiseerde voorbeelden van overlays of templates gebruiken voor marketingdoeleinden (bijv. op de homepage of in social media), mits daarbij niet herleidbaar is welke individuele gebruiker dit heeft gemaakt.

If you offer items via the StreamPilot marketplace, you grant Gamerun permission to display images and previews of those items to other users for marketplace purposes. In addition, Gamerun may use anonymised examples of overlays or templates for marketing purposes (e.g. on the homepage or in social media), provided that no individual user is identifiable from these examples.

7.3 Standaard-templates / Default Templates

Standaard overlay-templates, kaarten en stijlen die door Gamerun worden meegeleverd bij de dienst zijn eigendom van Gamerun. Je mag deze gebruiken binnen StreamPilot voor jouw eigen stream, maar niet buiten de dienst distribueren of als eigen werk te koop aanbieden.

Default overlay templates, cards and styles provided by Gamerun as part of the service are the property of Gamerun. You may use these within StreamPilot for your own stream, but you may not distribute them outside the service or offer them for sale as your own work.

7.4 StreamPilot-platform / StreamPilot Platform

Alle software, ontwerpen en andere inhoud van het StreamPilot-platform zelf zijn eigendom van Gamerun en worden beschermd door intellectuele eigendomsrechten. Je mag de software niet kopiëren, reverse-engineeren of op andere wijze reproduceren zonder schriftelijke toestemming van Gamerun.

All software, designs and other content of the StreamPilot platform itself are the property of Gamerun and protected by intellectual property rights. You may not copy, reverse-engineer or otherwise reproduce the software without Gamerun's written permission.

8. Beschikbaarheid / Availability

StreamPilot streeft naar een zo hoog mogelijke beschikbaarheid van de dienst, maar biedt geen gegarandeerde uptime (SLA). De dienst wordt aangeboden op basis van een inspanningsverplichting: Gamerun doet zijn best om de dienst beschikbaar, veilig en functioneel te houden, maar kan dit niet garanderen.

Gepland onderhoud wordt zo veel mogelijk vooraf aangekondigd via het dashboard of e-mail. Ongepland onderhoud of storingen bij externe partijen (hosting, CDN, derde platforms) vallen buiten de invloedssfeer van Gamerun.

StreamPilot aims for the highest possible availability of the service, but offers no guaranteed uptime (SLA). The service is provided on a best-efforts basis: Gamerun does its best to keep the service available, secure and functional, but cannot guarantee this.

Planned maintenance is announced in advance via the dashboard or email where possible. Unplanned maintenance or outages at external parties (hosting, CDN, third-party platforms) fall outside Gamerun's sphere of influence.

9. Beperking van aansprakelijkheid / Limitation of Liability

9.1 Algemeen / General

StreamPilot wordt aangeboden "zoals het is" (as-is). Gamerun is niet aansprakelijk voor directe of indirecte schade die voortvloeit uit het gebruik van de dienst, tenzij sprake is van opzet of bewuste roekeloosheid aan de zijde van Gamerun.

StreamPilot is provided "as is". Gamerun is not liable for direct or indirect damage arising from use of the service, unless caused by intent or wilful misconduct on the part of Gamerun.

9.2 Maximale aansprakelijkheid / Liability Cap

Mocht Gamerun ondanks het voorgaande aansprakelijk zijn, dan is die aansprakelijkheid te allen tijde beperkt tot het totaalbedrag dat je in de 12 maanden voorafgaand aan het schadeveroorzakende voorval aan Gamerun hebt betaald voor de dienst. Als je de dienst gratis gebruikt, is de maximale aansprakelijkheid van Gamerun beperkt tot € 50.

Should Gamerun be liable notwithstanding the above, that liability is at all times limited to the total amount you have paid to Gamerun for the service during the 12 months preceding the event giving rise to the damage. If you use the service free of charge, Gamerun's maximum liability is limited to € 50.

9.3 Uitgesloten schade / Excluded Damages

In het bijzonder is Gamerun niet aansprakelijk voor:

  • Indirecte schade, gevolgschade, gederfde winst of gemiste inkomsten uit streams;
  • Schade als gevolg van beschikbaarheids- of functionaliteitsproblemen bij externe platforms (Twitch, YouTube, Spotify, etc.);
  • Schade veroorzaakt door door gebruikers geüploade bestanden, inclusief claims van derden wegens inbreuk op intellectuele eigendomsrechten;
  • Dataverlies door omstandigheden buiten de controle van Gamerun;
  • Verlies van volgers, abonnees, inkomsten of reputatieschade in verband met het gebruik van StreamPilot.

In particular, Gamerun is not liable for:

  • Indirect damage, consequential damage, loss of profit or missed stream revenue;
  • Damage resulting from availability or functionality issues at external platforms (Twitch, YouTube, Spotify, etc.);
  • Damage caused by user-uploaded files, including third-party claims for infringement of intellectual property rights;
  • Data loss due to circumstances beyond Gamerun's control;
  • Loss of followers, subscribers, revenue or reputational damage in connection with the use of StreamPilot.

9.4 Vrijwaring / Indemnification

Je vrijwaart Gamerun voor alle aanspraken van derden die verband houden met: (a) door jou geüploade bestanden of content; (b) jouw gebruik van StreamPilot in strijd met deze voorwaarden; of (c) jouw schending van de voorwaarden van externe platforms.

You indemnify Gamerun against all third-party claims in connection with: (a) files or content uploaded by you; (b) your use of StreamPilot in breach of these terms; or (c) your violation of the terms of external platforms.

10. Privacy

Het verwerken van persoonsgegevens is beschreven in ons privacybeleid. Het privacybeleid maakt onderdeel uit van deze gebruiksvoorwaarden.

The processing of personal data is described in our privacy policy. The privacy policy forms part of these terms of service.

11. Wijzigingen in de dienst of voorwaarden / Changes to Service or Terms

Gamerun behoudt zich het recht voor de dienst en deze voorwaarden op elk moment te wijzigen. Bij ingrijpende wijzigingen in de voorwaarden ontvang je minimaal 14 dagen van tevoren een bericht per e-mail of via het dashboard. Voortgezet gebruik van de dienst na de ingangsdatum van de gewijzigde voorwaarden geldt als acceptatie. Als je niet akkoord gaat, kun je je account voor de ingangsdatum verwijderen; in dat geval heb je recht op restitutie van eventueel vooruitbetaald abonnementsgeld naar rato.

Gamerun reserves the right to change the service and these terms at any time. For material changes to the terms you will receive notice at least 14 days in advance by email or via the dashboard. Continued use of the service after the effective date of the amended terms constitutes acceptance. If you do not agree, you may delete your account before the effective date; in that case you are entitled to a pro-rata refund of any prepaid subscription fees.

12. Toepasselijk recht en geschillen / Governing Law and Disputes

Op deze voorwaarden en op het gebruik van StreamPilot is uitsluitend Nederlands recht van toepassing. Geschillen worden — tenzij partijen anders overeenkomen — voorgelegd aan de bevoegde rechter in het arrondissement waar Gamerun is gevestigd.

Als consument heb je het recht om een geschil voor te leggen aan de Geschillencommissie of gebruik te maken van het Europese ODR-platform.

These terms and the use of StreamPilot are exclusively governed by Dutch law. Disputes will — unless the parties agree otherwise — be submitted to the competent court in the district where Gamerun is established.

As a consumer you have the right to submit a dispute to the Dutch Disputes Committee (Geschillencommissie) or to use the European ODR platform.

13. Overig / Miscellaneous

Gehele overeenkomst: Deze voorwaarden, samen met het privacybeleid en eventuele aanvullende productspecifieke voorwaarden, vormen de volledige overeenkomst tussen jou en Gamerun met betrekking tot StreamPilot.

Scheidbaarheid: Als een bepaling in deze voorwaarden ongeldig of niet-afdwingbaar blijkt, tast dit de geldigheid van de overige bepalingen niet aan. De ongeldige bepaling wordt vervangen door een geldige bepaling die zo dicht mogelijk bij de oorspronkelijke bedoeling aansluit.

Geen afstand van rechten: Het feit dat Gamerun een bepaling niet handhaaft, houdt geen afstand van dat recht in voor de toekomst.

Entire agreement: These terms, together with the privacy policy and any additional product-specific terms, constitute the entire agreement between you and Gamerun with respect to StreamPilot.

Severability: If any provision of these terms is found invalid or unenforceable, this does not affect the validity of the remaining provisions. The invalid provision will be replaced by a valid provision that most closely reflects the original intent.

No waiver: The fact that Gamerun does not enforce a provision does not constitute a waiver of that right in the future.
